Interesting article. So what it boils down to is that the software license states the video cannot be used commercially without further licensing. And that license is applied to the final distributor. So if I encode video and send it to a studio or another person who takes it and packages it for sale, they would be responsible for the licensing. The distributor is responsible; which makes sense in this case. Otherwise if a license was charged for distribution all up the chain that would be a lot of dipping.
