MS Infringing on FOSS IP?

I found this article pretty interesting:

Makes me wonder: If this could be the case all the deals MS makes might not be able to help them. That one company that refuses the deal could go after MS. How would their other deals protect them? It's a one against many scenario where the many continues to grow.

But then again, how could any one company go after MS unless that company or organization was something like the OSI or FSF which I doubt would ever enter into an agreement with MS to begin with. No one company speaks for Linux or FOSS so who would spearhead the initiative if not either of those organizations?

What would be interesting is if the someone started send letters to the big companies stating that using MS Software violates their ip. It would be nice to see how the shoe fits on the other foot. I guess that is why google is making so much noise. Personally until the sco crap gets resolved there will always be Elmer Fud.
