Judge Kimball rules.

In the lawsuit that is between Sco and Novell has been finally ruled on by Judge Kimball. www.groklaw.net has all the details. I will not comment on it except to say that some people have been alleged that opensolaris maybe in trouble.

Time for SCO to pay up, and for Sun to have a talk with Novell, just in case.

A patent agreement between Sun and Novell is probably in the works now. Maybe this puts the patent agreement between Novell and Microsoft into a different light? Maybe Microsoft did the agreement with Novell to cover THEIR asses and not the other way around as everyone originally thought?

That won't be the case, because this whole debacle is not about patents, but copyrights. Which, IMO, is infinitely simpler to deal with. And if Novell owns UNIX source code that might be among the code Sun released under the Common Development and Distribution License (CDDL, or "cuddle"), I think Sun just needs to say to Novell, "Guys, we were cheated by SCO, what can we do to make sure we are in the clear?". And since Novell is partly an open source company, I think they will be easier (Not necessarily easy, but easier) to cut a deal with, than say HP.
